Terms & Conditions

Wherever used herein, the term “equipment” shall include any equipment rented from Irish Centre for CyclingIrish Centre for Cycling, its agents, servants, and employees shall not be responsible for personal injuries or property damage, loss or delay incurred by any person arising out of the act of negligence of any direct or supplemental carrier or other person rendering any of the services or products being offered in these rentals; nor shall Irish Centre for Cycling be responsible for any injuries, death, damage, loss or delay in any means of transportation or by reasons of any event beyond the actual control of Irish Centre for Cycling, or of any agent or supplier, or due to force majeure. Renters follow any suggested itinerary at their own risk and agree not to hold Irish Centre for Cycling or Cycling responsible for injury or death resulting from accidents. We strongly recommend the use of approved helmets whenever mounted on a bicycle. Helmets will be provided at no extra cost. The bicycles provided for use are in satisfactory operating condition and participants agree to use them at their own risk or call deficiencies to the attention of a company representative.  Instruction in the use of bicycles will not be provided and participants affirm that they are familiar with the use of a multi-speed bicycle.

 

BOOKING 
On receipt of a completed booking form and the Company will invoice you for the total cost of the activity. Final payment must be made no later than two days before the activity day. The Company reserves the right to cancel your booking should payment be received late. Payment can also be made on the day if previously arranged.

CANCELLATION BY YOU
On receiving written notice of your cancellation, you will be charged the following part of your total tour/lesson cost as a cancellation fee:
> 7 days notice, pay 0%
2 - 6 days notice, pay 50%
< 2 days notice, pay 100%.
The Company reserves the right to refuse any request to transfer to another tour/lesson.

BIKE HIRE 
a) All hired bikes remain the property of the Company and shall not be sold, hired or loaned out by the Client
b) The Client acknowledges that the bike hired is in good condition and undertakes to return the bike and any accessories in that same condition, or to make a payment to the Company, immediately on demand, sufficient to return the bike to that condition.
c) The Company shall not be liable for any damage or loss arising from the Clients use of the equipment. The Client shall indemnify the Company against any claim howsoever arising as a result of the Client’s use of the bike during the period of hire.
d) In the event that the bike and/or any accessories are lost or stolen the Client shall indemnify the Company for the costs of replacing those items. Should the equipment subsequently be returned in a satisfactory condition these moneys will be repaid.
e) The Client will ensure that the bike is adequately secured when not in use and will immediately notify the Company or one of it’s representatives in the event of any theft, loss, breakdown or other occurrence relating to the bike or associated accessories.
f) All moneys due in relation to the hire of bikes will be added to the tour/lesson cost.

COMPLAINTS
If you have a complaint about your tour you should communicate it to the leader so that remedial action can be taken if possible. In any event you must notify the Company of any complaint, in writing, within 14 days of the tour finish. 

RESPONSIBILITY FOR DAMAGE OR LOSS
Customer agrees he/she will return the equipment in the same good condition as when received, ordinary wear and tear accepted, and to repair and replace lost or stolen, damaged or broken bicycles or parts or to reimburse Irish Centre for Cycling for said equipment. Stolen or damaged equipment will be charged for as stated on our price replacement chart. Therefore regardless of the party at fault, customer understands and agrees to be responsible for the theft or damage to said equipment.

OTHER ACTIVITIES 
The Company acts as agent only in respect of all activities, whether or not included in the tour price, which are organised and operated by any other company. Your contract will be directly with the activity provider and subject to their booking conditions. 

TRANSPORTATION
In the event of an accident, the Company is not responsible for any personal injury to the client. The loss, damage or delay of belongings are the responsibility of the client. 

SUBLEASING PROHIBITED
Customer understands and agrees that any subleasing of rental equipment is prohibited and that any such sublease shall immediately cause termination and cancellation of this contract.

CUSTOMER LIABILITY
Customer shall assume liability for any and all damage or loss of and to personal property, accident / injury to other persons related to said rental equipment.

INSURANCE
We strongly recommend that you always carry a personal or travel insurance policy.

THEFT AND DAMAGE INSURANCE
You may pay an additional Theft & Damage insurance fee which will in case of theft or damage to the bicycle reduce the cost by 50%. This insurance is priced at €2 per bike and should be selected at the time of purchase.

IMAGE AND VIDEO CONTENT
The Client herby consents to the use of their images and videos being used by the Company for promotional and non promotional purposes. If you the Client do not consent to the use of an image or video in which you appear you must inform the Company in writing 7 days prior to the commencement of the tour. The Company reserves the right to use images and videos taken on tours however they wish.

TERMINATION OF AGREEMENT:
Customer agrees that
Irish Centre for Cycling has the right to terminate this agreement at any time and retake possession of said equipment and for said purpose Irish Centre for Cycling may enter upon the premises of the customer without becoming liable for trespass.

DEPOSIT :
We require a €50 deposit per bike hire for rentals of 7 days or more, balance due prior to delivery date.  We may require a damage deposit in the form of credit card charge plus the driver’s license / photo ID of one member of the party.  Any deposit given by the customer shall be applied to and guarantee the faithful performance of all the provisions of this agreement and all repairs necessary to said equipment. If any action is brought to enforce any of the terms of conditions of this agreement, or to recover any sums due to hereunder, customer agrees to pay all legal fees, court costs, or other expenses.

LATE RETURN FEE :
An additional day’s rental fee will be charged for each day customer keeps equipment after the return date specified on this contract. All equipment must be returned directly to
Irish Centre for Cycling or wherever agreed.

Summer Cycle Camp Terms & Conditions

1 Places will be filled on a first come first served basis.
2 A parent or guardian must sign application form & agree to terms & conditions. 
3 All medical conditions must be clearly stated on the application form or advised to Camp Director in writing. 
4 Children must bring a packed lunch, rain gear & sun cream each day. 
5 The hours of the camp are 9.30am-2.30pm each day. ICC & it’s employees are not responsible for children outside of the above hours. 
6 ICC does not accept responsibility for the loss or damage to any property belonging to the participants. 
7 Bikes are provided for use of the children. The use of a child’s own bike will be subject to its suitability & a full safety check by ICC staff.
8 Information of activities is given in good faith. All arrangements & activities are subject to change depending on weather conditions, programme schedule & other arrangements. ICC reserve the right to cancel, amend or alter activities accordingly.
9 If a child is unable to attend a full refund will be given if 7 days’ notice or a doctor’s note is given. 
10 Lost property will be kept until the end of September 2014. 
11 ICC reserves the right to suspend any child that is disruptive to the camp due to misbehaviour or whose behaviour puts them or others at risk. 
12 ICC reserves the right to cancel part of/or the entire programme.
13 All Participants are expected to know how to cycle a bike.
